Welcome to nextel.com, a service of Nextel Communications, Inc. All purchases of services or products through nextel.com are governed by our Terms of Sale Agreement. Please read it carefully before making a purchase. If you do not wish to accept our Terms of Sale, please do not purchase any services or products through our site. (When we refer to "Nextel Communications," "we," or "our" such references include Nextel Communications and our affiliated companies.)

The Web is an evolving medium. We may change the terms of this Terms of Sale Agreement from time to time without your prior notice. By continuing to use nextel.com after we post any revised Terms of Sale, you agree to the Terms of Sale, as revised.

Nextel Communications respects the privacy of visitors to our site. Please take a few minutes to review our Privacy Policy. By using nextel.com, you also accept the terms of our Visitor Agreement. If you have not already done so, please read it now.

Purchases
When you click on the "SUBMIT" or similar button on a product or service screen, you agree to purchase the products and services indicated, in accordance with the terms and conditions included on the relevant screens, and in accordance with this agreement and our General Terms and Conditions described below.
NO WARRANTIES BY NEXTEL COMMUNICATIONS
NEXTEL COMMUNICATIONS MAKES NO EXPRESS REPRESENTATIONS OR WARRANTIES ABOUT THE PRODUCTS AND SERVICES IT MAY PROVIDE, AND HEREBY DISCLAIMS ANY IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT. NEXTEL COMMUNICATIONS DOES NOT AUTHORIZE ANYONE TO MAKE A WARRANTY OF ANY KIND ON ITS BEHALF AND YOU MAY NOT RELY ON ANY STATEMENT OF WARRANTY. NEXTEL COMMUNICATIONS IS NOT THE MANUFACTURER OF THE PRODUCTS IT PROVIDES AND THE ONLY WARRANTY APPLICABLE TO SUCH PRODUCTS IS THAT PROVIDED BY THE PRODUCT MANUFACTURERS.
PRODUCT WARRANTY BY MANUFACTURER
Each Nextel Communications product available through this site comes with a limited warranty provided by the manufacturer.
LIMITATION OF LIABILITY
IF YOU USE NEXTEL.COM OR RELY ON ANY MATERIAL AVAILABLE THROUGH THIS SITE, YOU DO SO AT YOUR OWN RISK. YOU UNDERSTAND THAT YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM ANY MATERIAL DOWNLOADED FROM OR OTHERWISE PROVIDED THROUGH NEXTEL.COM. NEXTEL.COM IS PROVIDED TO YOU "AS IS," "WITH ALL FAULTS," AND "AS AVAILABLE." NEXTEL COMMUNICATIONS AND ITS AFFILIATES, AGENTS AND LICENSORS CANNOT AND DO NOT WARRANT THE ACCURACY, COMPLETENESS, CURRENTNESS, NONINFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF THE INFORMATION, SERVICES, OR PRODUCTS AVAILABLE THROUGH NEXTEL.COM. NOR DO THEY GUARANTEE THAT NEXTEL.COM WILL BE ERROR-FREE, OR CONTINUOUSLY AVAILABLE, OR THAT IT WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

UNDER NO CIRCUMSTANCES WILL NEXTEL COMMUNICATIONS OR ITS AFFILIATES, AGENTS OR LICENSORS BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DAMAGES ARISING OUT OF USE OF NEXTEL.COM. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING COMPENSATORY, SPECIAL, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES, EVEN IF WE ARE ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES. (BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN CATEGORIES OF DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH STATES, THE LIABILITY OF NEXTEL COMMUNICATIONS, AND ITS AFFILIATES, AGENTS AND LICENSORS IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW.) YOU AGREE THAT THE LIABILITY OF NEXTEL COMMUNICATIONS, AND ITS AFFILIATES, AGENTS AND LICENSORS, IF ANY, ARISING OUT OF ANY KIND OF LEGAL CLAIM IN ANY WAY CONNECTED TO NEXTEL.COM WILL NOT EXCEED ONE HUNDRED ($100.00) DOLLARS.

SHIPPING AND BILLING TO U.S. ADDRESSES ONLY/AVAILABILITY
Nextel Communications does not process orders to foreign shipping or billing addresses. Nextel Communications tries to give product availability information on this site, but sometimes products are unavailable despite our efforts. In addition, Nextel Communications updates and improves its products and services on a continuous basis. Nextel Communications will inform you if any Nextel Communications products that you ordered turn out to be unavailable or if any service that you ordered has been changed. Nextel Communications may use email to so inform you.
EMAIL RECEIPT
After you place an order by means of this site, you should receive an email acknowledgment within one business day to confirm that Nextel Communications has accepted your order and is processing it. The email will contain the details of your order, the itemized and total amounts that will be billed to your credit card, including all applicable taxes and other charges. Please review this receipt carefully to confirm that we properly understood your order. A printed receipt will also be included with your purchase.
CHARGING YOUR CREDIT CARD
After you submit your order, Nextel will place a "Hold" on your credit card for the order amount. Nextel will charge your credit card once the equipment has shipped. The "Hold" will remain on your credit card for up to 30 days or until your product is shipped. If your credit card is rejected, Nextel will not ship any products or activate any service for your account.
PRICES, TAXES AND SHIPPING & HANDLING
All prices are stated and payable in US dollars. The prices for products and services quoted on this site do no include taxes. Nextel Communications charges all applicable taxes on products and services. Shipping charges may apply.
RETURN POLICY - 14 DAY RISK FREE GUARANTEE
All phones and devices may be returned for a refund or credit within 14 days (30 days in CA) of activation. Accessories may be returned for a refund or credit within 14 days (30 days in CA) of purchase. Software accessories may be returned for refund or credit only if returned in the original packaging with seal unbroken within 14 days (30 days in CA) of purchase.  Terms and Conditions that apply to returns:

No returns will be accepted without the original receipt or packing slip (photocopy is acceptable).
Refunds for all equipment are based upon the sale price at the time of initial purchase.
All returns must contain all original components or parts.
Sprint reserves the right to charge a $25 fee per phone, device, or accessory returned without the original components, or parts.
Return eligibility will be based on purchase date for equipment that has not been activated.
If you received your phone/device through a “Buy One, Get One Or More Free” offer, all phones/devices must be returned in order to receive a refund.
$200 early termination fee waived and activation fees refunded if all components and parts of the original phone or device order are returned within the deactivation period.
No equipment service credits or equipment rebates will be honored.
A total cash refund up to $75 will be provided for cash purchases. Refunds in excess of $75 will be made by Company check issued within 14 business days.
Refunds for purchases made by check are subject to verification of funds and issued within 14 business days.
Bill to account purchase returns will be credited to the same account.
Customer is responsible for all accrued usage charges (if any), taxes, or service fees incurred through deactivation date.
Customer is responsible for deactivating service or transferring service to another phone or device prior to the equipment return.
